A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of goods or services. Registering your trademark with the United States Patent and Trademark Office (USPTO) gives you the exclusive right to use that mark nationwide in connection with your goods or services — and the legal standing to enforce it against anyone who infringes.
Without federal registration, your trademark rights are limited to the geographic area where you actually use the mark. Registration expands those rights nationally, creates a public record of your ownership, enables you to use the ® symbol, and provides access to federal courts for enforcement. It is one of the most cost-effective legal protections a business can obtain. When someone infringes your mark, enforcement begins with a cease and desist letter demanding they stop.
Copyright protects original works of authorship — including written content, software, designs, photography, music, and video. Copyright registration with the U.S. Copyright Office is not required for protection to exist, but it is required before you can file a federal lawsuit for infringement, and it enables you to recover statutory damages and attorney's fees.
