Protect Your Mark

What Is Trademark Protection

A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of goods or services. Registering your trademark with the United States Patent and Trademark Office (USPTO) gives you the exclusive right to use that mark nationwide in connection with your goods or services — and the legal standing to enforce it against anyone who infringes.

Without federal registration, your trademark rights are limited to the geographic area where you actually use the mark. Registration expands those rights nationally, creates a public record of your ownership, enables you to use the ® symbol, and provides access to federal courts for enforcement. It is one of the most cost-effective legal protections a business can obtain. When someone infringes your mark, enforcement begins with a cease and desist letter demanding they stop.

Copyright protects original works of authorship — including written content, software, designs, photography, music, and video. Copyright registration with the U.S. Copyright Office is not required for protection to exist, but it is required before you can file a federal lawsuit for infringement, and it enables you to recover statutory damages and attorney's fees.

Trademark and copyright services are structured as discrete, independent engagements. Each step ships on its own — you are never required to purchase the full sequence. Choose the steps you need based on where you are in the process.

Clearance Search + Opinion

A comprehensive search of federal, state, and common-law databases for conflicting marks, followed by a written opinion letter assessing registrability and risk.

USPTO Filing

How It Works

01

Tell us what you want to protect

Describe the mark, logo, creative work, or brand element you want to protect. Tell us how and where you use it, and whether you have encountered any conflicts.

02

We recommend a path

Based on what you need, we recommend specific steps — clearance search, opinion letter, USPTO filing, copyright registration, or enforcement action. Each step is quoted independently.

03

Work product delivered

Each step produces a defined deliverable — a written opinion, a filed application, a registration certificate, or an enforcement letter. You receive your deliverable and a close-out letter for that step.

04

Next steps are yours

You decide whether to proceed to the next step, pause, or stop. There is no obligation to continue beyond any single engagement.

Experience

The DO MOORE® brand system includes five federally registered trademarks — each cleared, filed, and maintained through the same process offered to clients. The brand you are looking at right now is the proof.

Brenden M. Moore's intellectual property experience spans trademark portfolio management, licensing agreements, and enforcement actions across multiple industries. His understanding of brand protection is not academic — it comes from building and defending a brand system from scratch. When marks need to be licensed, the licensing agreement is reviewed with the same rigor.

I built a five-trademark brand system before I ever filed one for a client. Every clearance search, every office action, every renewal — I've done it for my own marks first.
